1. Agrees to indemnify, defend, protect and hold harmless the sponsors, organization and all its associates, the proprietors of the location and all its associates, the municipality where the event is held at and all its associates, JC Promotions, Inc, its employees, agents and all its associates for any personal injury to himself\herself and his\her associates for any property loss or damages of any nature suffered by any person as a result of the operation of the above mentioned or the exhibitors and especially to the attendees while within the undersigned exhibitor space or caused by the exhibitor. Exhibitor may not assign their contract for exhibit space or permit any other person to use part of such space.
2. Exhibitor agrees to hold harmless the sponsors, organization and all its associates, the proprietors of the location and all its associates, the municipality where the event is held at and all its associates, JC Promotions, Inc, its employees, agents and all its associates for any merchandise left unattended for any reason at any event at any time.
3. Agrees should an accident occur within the exhibitors space caused by the undersigned exhibitor display or debris left by the exhibitor, the exhibitor will be held liable in case of an accident. By applying to any events listed, the exhibitor agrees to save and hold harmless JC Promotions, Inc, its management, agents, employees, the municipality where the event is held, its management agents, employees, and sponsors from any liability resulting from such accidents.
4. Exhibitor agrees to set-up at least one hour prior to event opening and remain open until closing time of event.
5. Agrees to remove all boxes, paper and trash belonging to them upon vacating their space and to keep his\her space neat in appearance and in good order while selling. Exhibitor is not allowed to deposit trash in barrels or cans available for Event patrons.
6. ALL EXHIBITS MUST BE NEAT- tables must be draped with attractive cloths and with no visible boxes.
7. Undersigned exhibitor exhibit or products may not extend beyond the limits of exhibitor booth or into any side space, sidewalk or street.
8. Agrees to read and be responsible to comply with all the rules and regulations in this contract.
9. Provide own tables, chairs, racks and display materials unless otherwise noted. No water or electric is supplied. Rain or shine, vendors are advised to come prepared for inclement weather, tarps, plastic covers, etc.
10. The sale of knives, box cutters, unlicensed products, spray foam, fake cigarettes, streamers, sparklers, bomb bags, stink bombs, snappers, pornographic material, firearms, explosives, smoke and/or odorous items flammables or any item deemed illegal under the law is strictly prohibited. The sale of cigarette lighters to minor children (under the age of eighteen) is strictly prohibited.
11. Exhibitor is entirely responsible for the collection and payment of any state sales tax.
12. Exhibitor is responsible for maintaining product liability.
13. Soliciting of Exhibitors is not permitted.
14. Exhibitor is to park vehicle in designated area, away from vendor space (unless otherwise indicated)
15. Exhibitor agrees that the termination of this contract by the undersigned allows the sponsor to retain the total deposit as a liquidation/ or assess a $50 cancellation fee. We accept your contract in good faith and expect you to honor your commitment.
16. Events will be held rain or shine (come prepared). If the event or contract is canceled for ANY REASON there will be NO raindate. NO refunds, NO credits or NO transfers due to the undersigned and/or reserved exhibitor.
17. No religious or political solicitation permitted. JC reserves the right to refuse rental space to any exhibitor upon their discretion and reserves the right to exclude any merchandise from an event for any reason at any time.
18. No exhibitor or vendor may offer any of the following goods or services without the written consent of JC Promotions, Inc. Any food item, beverage, face-painting, ride, game, temporary tattoo or any item for FREE or below market value.
19. This agreement applies to all and any future events between JC Promotions, Inc. and the undersigned.
